Twenty-seven billion FBR and Customs tax cases have been pending for decades
ان لینڈ ریونیو کے 24 سو ارب اور کسٹمز کے اڑھائی سو ارب روپے سے زائد کے تقریباً 90 ہزار ٹیکس کیسز التوا کا شکار ہیں۔
ایف بی آر دستاویز کے مطابق ان لینڈ ریونیو کے سپریم کورٹ میں 95 ارب روپے سے زائد کے 3271، اسلام آباد ہائیکورٹ میں 180 ارب کے 11 سو، سندھ ہائی کورٹ میں سوا 2 سو ارب کے 26 سو اور لاہور ہائی کورٹ میں پونے 4 سو ارب کے تقریباً 5700 کیسز زیر التوا ہیں۔
اسی طرح ایف بی آر کے پشاور ہائی کورٹ میں 10 ارب کے 4 سو، بلوچستان ہائی کورٹ میں 3 ارب کے 11 اور ایپلٹ ٹریبونلز میں 15 سو 15 ارب روپے تک کے 62298 ٹیکس کیسز التوا کا شکار ہیں۔
دستاویز کے مطابق کسٹمز کے سپریم کورٹ میں 12 ارب روپے سے زائد کے 1432، اسلام آباد ہائیکورٹ میں 2 ارب کے 203، سندھ ہائی کورٹ میں تقریباً ڈیڑھ سو ارب کے 55 سو اور لاہور ہائی کورٹ میں 6 ارب کے تقریباً 548 کیسز اپنے منطقی انجام تک پہنچنے کے منتظر ہیں۔
اس طرح پشاور ہائی کورٹ میں 2 ارب کے 676، بلوچستان ہائی کورٹ میں 3 ارب کے 58 اور ایپلٹ ٹریبونلز کسٹمز میں 73 ارب تک کے 4911 ٹیکس کیسز التوا کا شکار ہیں۔
مختلف عدالتوں میں التوا کے شکار ٹیکس کیسز کو جلد حل کرنے کیلئے وزیراعظم شہباز شریف نے چیف جسٹس سپریم کورٹ سے ملاقات کی ہے۔
دوسری جانب وزیرخزانہ محمد اورنگزیب، اٹارنی جنرل منصور اعوان اور چیئرمین ایف بی آر امجد زبیر ٹوانہ کے درمیان بھی ٹیکس کیسز کو جلد حل کرنے کیلئے مختلف تجاویز پر غور کیا جا رہا ہے۔
ذرائع کے مطابق سپریم کورٹ، اسلام آباد ہائیکورٹ، سندھ ہائیکورٹ، لاہور ہائیکورٹ، پشاور ہائیکورٹ، بلوچستان ہائیکورٹ اور ایپلٹ ٹریبونلز میں ٹیکس کیسز تقریباً دو دہائیوں سے التوا کا شکار ہیں، متعدد کیسز ایف بی آر ہائیکورٹس سے ہار چکا ہے جس کیلئے سپریم کورٹس میں اپیل دائر کی گئی ہیں۔
About 90 thousand tax cases worth more than 2400 billion rupees of Inland Revenue and 250 billion rupees of Customs are pending.
According to the FBR document, there are 3271 cases of more than 95 billion rupees in the Supreme Court of Inland Revenue, 1100 cases of 180 billion rupees in the Islamabad High Court, 26 hundred cases of more than 200 billion rupees in the Sindh High Court and 4 hundred cases in the Lahore High Court. About 5700 cases of Arb are pending.
Similarly, 62298 tax cases worth up to Rs. 10 billion in Peshawar High Court of FBR, 11 of Rs. 3 billion in Balochistan High Court and 1515 billion in Appellate Tribunals are pending.
According to the document, 1432 cases of more than 12 billion rupees in the Supreme Court of Customs, 203 cases of 2 billion rupees in the Islamabad High Court, 5500 cases of about 150 billion rupees in the Sindh High Court and 548 cases of 6 billion rupees in the Lahore High Court. Thus, 676 tax cases worth 2 billion in Peshawar High Court, 58 tax cases worth 3 billion in Balochistan High Court and 4911 tax cases worth 73 billion in Appellate Tribunals Customs are pending.
Prime Minister Shehbaz Sharif has met the Chief Justice of the Supreme Court to quickly resolve pending tax cases in various courts.
On the other hand, various proposals are being considered between Finance Minister Muhammad Aurangzeb, Attorney General Mansoor Awan and Chairman FBR Amjad Zubair Towana to resolve the tax cases quickly.
According to the sources, tax cases have been pending in the Supreme Court, Islamabad High Court, Sindh High Court, Lahore High Court, Peshawar High Court, Balochistan High Court and Appellate Tribunals for almost two decades. Appeals have been filed.
