Government asked the Supreme Court for the amount of dams funds

چیف جسٹس پاکستان قاضی فائز عیسیٰ کی سربراہی میں چار رکنی بینچ نے سماعت کی ، ایڈیشنل اٹارنی جنرل عامر رحمان نے کہا کہ ہم نے ایک متفرق درخواست دائر کی ہے، ڈیمز فنڈز کے پیسے وفاق اور واپڈا کو دیے جائیں، سپریم کورٹ کی نگرانی میں سٹیٹ بنک نے اکاؤنٹ کھولا تھا، جس پر چیف جسٹس پاکستان نے استفسار کیا کہ ڈیمز فنڈز میں کتنے پیسے ہیں؟ جس پر وکیل واپڈا سعد رسول نے بتایاکہ تقریباً 20 ارب روپے ڈیمز فنڈز میں موجود ہیں۔
چیف جسٹس نے استفسار کیا کہ یہ کیس شروع کیسے ہوا،؟ جس پر وکیل واپڈا نے جواب دیا کہ سپریم کورٹ نے واپڈا کے زیر سماعت مقدمات کے دوران 2018 میں ازخود نوٹس لیا تھا، سپریم کورٹ کے ڈیمز فنڈز عمل درآمد بینچ نے 17 سماعتیں کیں، جس پر چیف جسٹس نے کہاکہ واپڈا کے اور بھی کئی منصوبے ہونگے، کیا سپریم کورٹ واپڈا کے ہر منصوبے کی نگرانی کرتی ہے؟ ۔
وکیل واپڈا نے کہا کہ ڈیمز کی تعمیر کے معاملے پر پرائیویٹ فریقین کے درمیان بھی تنازعات تھے، سپریم کورٹ نے پرائیویٹ فریقین کے تنازعات متعلقہ عدالتوں کے بجائے اپنے پاس سماعت کیلئے مقرر کیے ہماری استدعا ہے کہ پرائیویٹ فریقین کے تنازعات متعلقہ عدالتی فورمز پر ہی چلائے جانے چاہیے۔
عدالت نے کیس کا متعلقہ ریکارڈ طلب کرتے ہوئے کیس کی سماعت میں مختصر وقفہ کردیا۔وقفے کے بعد کیس کی سماعت کا دوبارہ آغاز ہوا، سپریم کورٹ نے رقم وفاقی حکومت کو دینے کے معاملے پر آڈیٹر جنرل پاکستان کو نوٹس جاری کر دیا۔
سپریم کورٹ نے حکم دیا کہ آڈیٹر جنرل پاکستان خود یا مجاز افسر آئندہ سماعت پر پیش ہوں اور ڈیمز فنڈ کی رقم وفاق کو دینے سے متعلق معاونت کی جائے، سابق اٹارنی جنرلز خالد جاوید اور انور منصور کو آئندہ سماعت پر طلب کر لیا گیا ۔
عدالت عظمیٰ نے عدالتی معاون مخدوم علی خان بھی آئندہ سماعت پر طلب کرلیا، ڈیمز کی تعمیر اور عملدرآمد بنچ سے متعلق عدالت کی معاونت کی جائے، سپریم کورٹ نے مقدمے کے دیگر فریقین کو بھی نوٹسز جاری کرتے ہوئے سماعت تین ہفتوں کیلئے ملتوی کردی ۔

A four-member bench headed by Chief Justice of Pakistan Qazi Faiz Isa heard, Additional Attorney General Aamir Rehman said that we have filed a separate application, the money of dams funds should be given to the federation and WAPDA, under the supervision of the Supreme Court. The bank had opened an account, on which the Chief Justice of Pakistan inquired how much money is in the dams funds? On which WAPDA lawyer Saad Rasool said that about 20 billion rupees are available in dams funds.
The Chief Justice inquired how this case started. To which WAPDA’s lawyer replied that the Supreme Court had taken automatic notice in 2018 during the cases under hearing of WAPDA, the Dams Fund Implementation Bench of the Supreme Court held 17 hearings, on which the Chief Justice said that there are many other projects of WAPDA. Yes, does the Supreme Court supervise every project of WAPDA? .

The court took a short break in the hearing of the case by asking for the relevant records of the case. After the break, the hearing of the case resumed, the Supreme Court issued a notice to the Auditor General of Pakistan on the issue of giving the money to the federal government.
The Supreme Court ordered that the Auditor General of Pakistan himself or an authorized officer should appear at the next hearing and support should be given regarding giving the amount of dams fund to the Federation. Former Attorney Generals Khalid Javed and Anwar Mansoor were summoned for the next hearing.
The Supreme Court has also summoned the judicial assistant Makhdoom Ali Khan for the next hearing. He should assist the court regarding the construction and implementation of the dams.
