The decisions of the Lahore High Court and the Election Commission on the formation of the Election Tribunal are suspended

سپریم کورٹ نے الیکشن ٹریبونل کی تشکیل کے لاہور ہائیکورٹ اور الیکشن کمیشن کے فیصلے معطل کردیئے۔
چیف جسٹس پاکستان کی سربراہی میں پانچ رکنی بینچ نے لاہورہائیکورٹ کے الیکشن ٹریبونلزکی تشکیل سے متعلق فیصلے پر الیکشن کمیشن کی اپیل پر سماعت کی،دوران سماعت الیکشن کمیشن کے وکیل سکندر بشیر نے کہا کہ نیاز اللہ نیازی جن کے وکیل ہیں انہوں نے فریق بننے کی استدعا کر رکھی تھی، عدالت نے فریق بننے کی استدعا منظور کر لی تھی۔
چیف جسٹس سے نے سلمان اکرم سے سوال کیا کہ کیا آپ نے مجھ پر اعتراض کیا تھا؟ اس پر سلمان اکرم نے جواب دیا میں نے اپنی ذاتی حیثیت میں اعتراض نہیں کیا تھا، چیف جسٹس نے کہا کہ عدالت کو بہت اسکینڈلائز کیا جاچکا ہے، اب بہت ہوچکا، کیوں نہ نیازاللہ نیازی کا کیس ڈسپلنری ایکشن کےلیے پاکستان بار کو بھیجیں؟ گزشتہ سماعت پر 2 رکنی بینچ کا بھی میں سربراہ تھا تب اعتراض کیوں نہ کیا؟ بینچ اب میں اکیلا نہیں بلکہ پوری کمیٹی بناتی ہے، جب ایک بندہ بینچ بناتا تھا تب کبھی اعتراض نہیں کیا گیا۔
جسٹس جمال مندوخیل نے کہا کہ ہمیں کمیٹی نے بینچ میں ڈالا ہے،کیا یہاں بےعزتی کرانے بیٹھے ہیں؟ ہم 3 ارکان بینچ میں بعد میں شامل ہوئے، بظاہر اعتراض مجھ پر ہے اس پر نیاز اللہ نیازی نے جواب دیا ہمیں آپ پر اعتراض نہیں۔
نیاز اللہ نیازی نے کہا کہ پہلی سماعت میں ہم فریق نہیں تھے، جو شخص جیل میں ہے اس کا بھی اعتراض ہے، میں اپنے موکل کے کہنے پر اعتراض کر رہا ہوں، اس پر چیف جسٹس نے کہا کہ جس شخص کا ذکر کررہے ہیں وہ جیل سے ویڈیو لنک پر پیش ہوچکا ہے اور انہوں نے بینچ پر کوئی اعتراض نہیں کیا تھا۔
چیف جسٹس نے کہا کہ بینچ پر اعتراض اٹھاکر ہیڈ لائنز بنوانا چاہتے ہیں، سپریم کورٹ کو سیکنڈلائز کرنے والے وکیل کا لائسنس معطل کریں گے، ایسا نہیں ہوسکتا جو منہ میں آئے کہہ دیں،بس آپ لوگ کیس خراب کرنا چاہتے ہیں۔

The Supreme Court suspended the decisions of the Lahore High Court and the Election Commission on the formation of the Election Tribunal.
A five-member bench headed by the Chief Justice of Pakistan heard the appeal of the Election Commission on the decision of the Lahore High Court regarding the formation of election tribunals. had requested, the court accepted the request to become a party.
The Chief Justice asked Salman Akram whether he objected to me. To this, Salman Akram replied that I had not objected in my personal capacity, the Chief Justice said that the court has been scandalized a lot, now it is enough, why not send Niazullah Niazi’s case to the Pakistan Bar for disciplinary action? I was also the head of the 2-member bench on the previous hearing, so why didn’t I object? The bench no longer constitutes a single committee but the entire committee, no objection was ever raised when one person constituted the bench.
Justice Jamal Mandukhel said that the committee has put us in the bench, are we sitting here to be insulted? We 3 members joined the bench later, apparently the objection is on me to which Niazullah Niazi replied we have no objection to you.
Niazullah Niazi said that we were not a party in the first hearing, the person who is in jail also has an objection, I am objecting to what my client said. The video from the jail has been shown on the link and he did not object to the bench.
The Chief Justice said that they want to make headlines by raising objections on the bench, they will suspend the license of the lawyers who are secondary to the Supreme Court.
