Supreme Court’s order to give reserved seats to Pakistan Tehreek-e-Insaaf

سپریم کورٹ آف پاکستان نے پشاور ہائیکورٹ کا فیصلہ اور الیکشن کمیشن کا حکم کالعدم قرار دیتے ہوئے مخصوص نشستیں پاکستان تحریک انصاف کو دینے کا حکم دے دیا۔
چیف جسٹس پاکستان قاضی فائز عیسٰی کی سربراہی میں 13 رکنی فل کورٹ نے الیکشن کمیشن کے فیصلے کو غیر آئینی قرار دے دیا۔
جسٹس سید منصور علی شاہ، جسٹس منیب اختر، جسٹس یحییٰ آفریدی، جسٹس امین الدین خان، جسٹس جمال خان مندوخیل، جسٹس محمد علی مظہر، جسٹس عائشہ ملک، جسٹس اطہر من اللہ، جسٹس سید حسن اظہر رضوی، جسٹس شاہد وحید، جسٹس عرفان سعادت خان اور جسٹس نعیم اختر افغان فل کورٹ کا حصہ ہیں۔
چیف جسٹس پاکستان نے بتایا کہ سنی اتحاد کونسل کی درخواست پر فیصلہ 8 کی اکثریت کا فیصلہ ہے، فیصلہ جسٹس منصور علی شاہ نے تحریر کیا ہے۔
جسٹس قاضی فائز عیسٰی نے بتایا کہ فیصلہ 5-8 کے تناسب سے ہے۔
سپریم کورٹ کے کمرہ نمبر ایک میں الیکشن کمیشن کے وکیل سکندر بشیر، اٹارنی جنرل منصور اعوان اور پی ٹی آئی رہنماؤں کی موجودگی میں فیصلہ سنایا گیا۔

The Supreme Court of Pakistan annulled the decision of the Peshawar High Court and the order of the Election Commission and ordered to give certain seats to Pakistan Tehreek-e-Insaaf.
A 13-member full court headed by Chief Justice of Pakistan Qazi Faiz Isa declared the Election Commission’s decision unconstitutional.
Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Yahya Afridi, Justice Aminuddin Khan, Justice Jamal Khan Mandukhel, Justice Muhammad Ali Mazhar, Justice Ayesha Malik, Justice Athar Manullah, Justice Syed Hasan Azhar Rizvi, Justice Shahid Waheed, Justice Irfan. Saadat Khan and Justice Naeem Akhtar are part of the Afghan Full Court.
The Chief Justice of Pakistan said that the decision is a majority decision of 8 on the request of the Sunni Unity Council, the decision was written by Justice Mansoor Ali Shah.
Justice Qazi Faiz Isa said that the decision is in the ratio of 5-8.
In the Supreme Court’s room number one, the decision was pronounced in the presence of election commission lawyer Sikandar Bashir, Attorney General Mansoor Awan and PTI leaders.
