حکومت نے جسٹس ریٹائرڈ فقیر محمد کھوکھر کو لاپتہ افراد کمیشن کا سربراہ مقرر کردیا۔

دوران سماعت ایڈیشنل اٹارنی جنرل نے عدالت کو بتایا کہ حکومت نے جسٹس ریٹائرڈ جاوید اقبال کی جگہ کمیشن کا نیا سربراہ لگا دیاہے، حکومت قانون سازی کے ذریعے لاپتہ افراد ٹریبونل بنانا چاہتی ہے۔
جسٹس محمد علی مظہر نے ریمارکس میں کہا کہ لاپتہ افراد ٹریبونل کیلئے تو قانون سازی کرنا پڑے گی جس پر ایڈیشنل اٹارنی جنرل نے عدالت کو بتایا کہ قانون سازی کیلئے کابینہ کمیٹی کام کر رہی ہے، جسٹس محمد علی مظہر نے استفسار کیا کہ کتنے عرصہ میں قانون سازی کا عمل مکمل ہوگا؟
جسٹس جمال خان مندوخیل نے ریمارکس میں کہا کہ قانون تو پہلے سے موجود ہے، کسی کو لاپتہ کرنا جرم ہے، کسی نے جرم کیا ہے تو ٹرائل کریں، جرم نہیں کیا تو اس کو چھوڑیں ۔
ایڈیشنل اٹارنی جنرل نے عدالت کو بتایا کہ وفاقی حکومت ایک مرتبہ لاپتہ افراد کے معاملے کو سیٹ کرنا چاہتی ہے جس پر جسٹس جمال خان مندوخیل نے کہا کہ اگر مسئلہ حل کرنا ہوتا تو لاپتہ افراد کا معاملہ حل ہو چکا ہوتا۔
جسٹس حسن اظہر رضوری نے استفسار کیا کہ اب تک کمیشن نے کتنے لاپتہ افراد کو ریکور کیا؟ کیا بازیاب ہونے والے آکر بتاتے کہ وہ کہاں تھے؟
رجسٹرار لاپتہ افراد کمیشن نے کہا کہ بازیاب ہونے والے نہیں بتاتے وہ کہاں پر تھے اس پر جسٹس مسرت ہلالی نے ریمارکس میں کہا کہ لاپتہ افراد کمیشن قانون سازی کرے، جسٹس جمال خان مندوخیل نے کہا کہ ہم امید ہی کر سکتے ہیں کہ مسئلے کو حل کیا جائے گا، پارلیمنٹ کو قانون سازی کا نہیں کہہ سکتے۔
بعدازاں عدالت نے لاپتہ افراد سے متعلق کیس کی مزید سماعت غیر معینہ مدت کیلئے ملتوی کردی۔

Justice Jamal Khan Mandukhel said in his remarks that the law already exists, missing someone is a crime, if someone has committed a crime, then try it, if he has not committed a crime, let him go.
The Additional Attorney General told the court that the federal government wants to settle the case of missing persons once, on which Justice Jamal Khan Mandukhel said that if the problem was to be solved, the case of missing persons would have been solved.
Justice Hasan Azhar Razuri inquired how many missing persons have been recovered by the commission so far? Will the survivors come and tell where they were?
Registrar Missing Persons Commission said that the recovered persons do not tell where they were, Justice Musrat Hilali said in his remarks that the Missing Persons Commission should legislate, Justice Jamal Khan Mandukhel said that we can only hope to solve the problem. Parliament cannot be asked to legislate.
Later, the court adjourned the further hearing of the missing persons case for an indefinite period.
