The Supreme Court restored the NAB amendments

سپریم کورٹ نے قومی احتساب بیورو ترامیم کالعدم قرار دینے کے خلاف وفاقی حکومت سمیت دیگر متاثرین کی انٹرا کورٹ اپیلیں منظور کرتے ہوئے نیب ترامیم کالعدم قرار دینے کا فیصلہ کالعدم قرار دے دیا اور نیب ترامیم بحال کردیں۔
چیف جسٹس پاکستان قاضی فائز عیسیٰ کی سربراہی میں 5 رکنی بنچ نے فیصلہ سنایا سپریم کورٹ نے فیصلہ 0-5 سے سنایا ہے۔
جسٹس امین الدین خان، جسٹس جمال خان مندوخیل، جسٹس اطہر من اللّٰہ اور جسٹس حسن اظہر رضوی بینچ میں شامل ہیں۔عدالت عظمیٰ نے اپنے فیصلے میں کہا ہے کہ بانی پی ٹی آئی عمران خان ثابت نہیں کر سکے کہ نیب ترامیم غیر آئینی ہیں۔
عدالتِ عظمیٰ نے نیب ترامیم کالعدم قرار دینے کے خلاف اپیلوں پر 3 ماہ بعد محفوظ فیصلہ سناتے ہوئے نیب ترامیم بحال کر دیں۔سپریم کورٹ نے فیصلے میں کہا ہے کہ 3 رکنی بنچ کا فیصلہ ثابت نہیں کر سکا کہ نیب ترامیم آئین سے متصادم تھیں۔
5 رکنی لارجر بنچ نے 3 رکنی بنچ کے فیصلے کے خلاف دائر وفاقی حکومت کی انٹرا کورٹ اپیل کی سماعت مکمل ہونے کے بعد 6 جون 2024ء کو فیصلہ محفوظ کر لیا تھا۔

The Supreme Court, while accepting the intra-court appeals of the federal government and other victims against the nullification of the National Accountability Bureau amendments, annulled the decision to nullify the NAB amendments and restored the NAB amendments.
A 5-member bench headed by Chief Justice of Pakistan Qazi Faiz Isa gave the decision. The Supreme Court has given the decision by 0-5.
Justice Aminuddin Khan, Justice Jamal Khan Mandukhel, Justice Athar Manullah and Justice Hasan Azhar Rizvi are included in the bench. The Supreme Court has said in its decision that PTI founder Imran Khan could not prove that the NAB amendments are unconstitutional.
The Supreme Court restored the NAB amendments after 3 months on the appeals against declaring the NAB amendments invalid.
The 5-member larger bench had reserved the decision on June 6, 2024 after completing the hearing of the federal government’s intra-court appeal filed against the decision of the 3-member bench.
