PTI worker’s missing case: Court’s strong expression of indignation

اسلام آباد ہائی کورٹ میں پی ٹی آئی کے لاپتا کارکن فیضان کی بازیابی کی درخواست پر جسٹس میاں گل حسن اورنگزیب کے روبرو سماعت ہوئی، ایڈیشنل اٹارنی جنرل منور اقبال دوگل عدالت کے سامنے پیش ہوئے۔
جسٹس اورنگزیب نے ایڈیشنل اٹارنی جنرل سے مکالمے میں سخت اظہار برہمی کیا اور کہا کہ آئین کو تبدیل کر دیں بنیادی حقوق اس میں سے نکال دیں، ہمارا دائرہ اختیار ختم کر دیں ملک کو اسی طرح چلائیں، مجھے نہیں معلوم سٹیٹ اس سے کیا حاصل کرنا چاہتی؟ آپ اس کی گرفتاری ڈال دیں ہم کچھ نہیں کہیں گے لیکن ملک اس طرح نہ چلائیں۔
جسٹس میاں گل حسن اورنگزیب نے کہا کہ وزارت دفاع اور وزارت داخلہ سٹیٹ سب اس سے خوش ہیں، مجھے سمجھ نہیں آرہی یہ کیا ہو رہا ہے اس سے کیا حاصل کرنا چاہتے ہیں؟ پہلے جس بنچ میں کیس تھا انہوں نے لکھا ہے یہ جبری گمشدگی کا کیس ہے، یہ ظالمانہ عمل ہے اس صورت حال میں آئینی عدالتوں کو کیا کرنا چاہیے؟ دنیا دیکھ رہی ہے پاکستانی عدالتیں (لاپتا افراد) ان کیسز میں کیا کر رہی ہیں، یا پھر یہ کہیں دنیا یہاں آئے سرمایہ کاری کرے اور لوگ مسنگ بھی ہوں گے اور عدالتیں بھی کچھ نہیں کر سکیں گے۔
جسٹس اورنگزیب نے کہا کہ وفاقی حکومت کا مطلب وزیراعظم اور وفاقی کابینہ ہے اور ذمہ داری آخر کار ایگزیکٹو ہیڈ پر آتی ہے۔سرکاری وکیل نے کہا کہ درخواست گزاروں نے صاف ہاتھوں کے ساتھ عدالت کا دروازہ نہیں کھٹکھٹایا۔
عدالت نے کہا کہ انہوں نے صاف ہاتھوں سے درخواست دائر نہیں کی، اس لیے درخواست خارج کر دیں؟ آپ چاہتے ہیں کہ میں خدمت گزار جج بن جاؤں؟ یہ گندے درخواست گزار ہیں ہم درخواست مسترد کر دیتے ہیں، میں سمجھ نہیں پا رہا کہ آپ ہمیں کس طرف لے کر جا رہے ہیں، ایڈیشنل اٹارنی جنرل صاحب آپ ہی مجھے بتا دیں کہ مجھے کیا کرنا چاہیے؟ حکومت اگر اسے جبری گمشدگی کا کیس کہتی ہے تو دیکھے کہ یہ کس کے کہنے پر ہوا، حکومت کو اس معاملے پر اغواء کاروں کے ساتھ بیٹھنے کی ضرورت ہے۔
ایڈیشنل اٹارنی جنرل نے کہا کہ یہ تو ہمیں نہیں پتا کہ اغواء کار کون ہیں۔جسٹس گل حسن اورنگزیب نے کہا کہ ہمارے ایک ساتھی جج نے سخت آرڈر کیا تو حکومتی پروپیگنڈا مشینوں نے اس کے خلاف پروپیگنڈا شروع کردیا، میں اس کیس میں آرڈر پاس کروں گا۔

Justice Mian Gul Hasan Aurangzeb said that the Ministry of Defense and the Ministry of Interior are all happy with this, I don’t understand what is happening, what do they want to achieve from it? The bench in which the case was before has written that it is a case of forced disappearance, it is a cruel act, what should the constitutional courts do in this situation? The world is watching what the Pakistani courts (missing persons) are doing in these cases, or else the world will invest here and people will be missing and the courts will not be able to do anything.
Justice Aurangzeb said that the federal government means the prime minister and the federal cabinet and the responsibility ultimately falls on the executive head. The government lawyer said that the petitioners did not knock the door of the court with clean hands.
The court said that they did not file the application with clean hands, so dismiss the application? You want me to become a serving judge? These are dirty applicants, we reject the application, I don’t understand where you are taking us, Additional Attorney General sir, tell me what should I do? If the government calls it a case of enforced disappearance, see who it was at the behest of, the government needs to sit down with the abductors on this issue.
The Additional Attorney General said that we do not know who the kidnappers are. Justice Gul Hasan Aurangzeb said that one of our fellow judges gave a strict order and the government’s propaganda machines started propaganda against him. I passed the order in this case. will do
