What to do with the unconstitutional bench that is sitting? Justice Mansoor Ali Shah

سپریم کورٹ میں ٹیکس سے متعلق کیس کی سماعت کے دوران آئینی بینچ کا تذکرہ کیا گیا۔ جسٹس منصور علی شاہ کی سربراہی میں 3 رکنی بینچ نے کیس کی سماعت کی۔
سماعت کے دوران جسٹس عائشہ ملک نے کہا کہ کیس آئینی بینچ سنے گا، ہم ریگولر بینچ میں کیس کی سماعت کر رہے ہیں۔
جسٹس منصور علی شاہ نے کہا کہ فی الحال کوئی آئینی بینچ نہیں تو یہ جو غیر آئینی بینچ بیٹھا ہے اس کا کیا کرنا ہے؟ جب تک آئینی بینچ نہیں بیٹھے گا تو کیا ہم غیر آئینی ہیں؟ مطلب جب تک آئینی بینچ نہیں بیٹھتا تب تک آئینی کیسز نہیں سنے جائیں گے۔
انہوں نے کہا کہ ہم اس کیس کو سن بھی لیں تو کوئی ہم سے پوچھ نہیں سکتا، بار بار سوال سامنے آتا ہے کہ کیس ریگولر بینچ سنے گا یا آئینی بینچ، اگر ہم کیس کا فیصلہ کر بھی دیتے ہیں تو کیا ہو گا؟ ہمیں کون روکنے والا ہے؟ نظرِ ثانی بھی ہمارے پاس آئے گی تو ہم کہہ دیں گے کہ ہمارا دائرہ اختیار ہے، آئینی کیسز ریگولر بینچ نہیں سن سکتا، وکلاء کی طرف سے بھی کوئی معاونت نہیں آ رہی۔
جسٹس عقیل عباسی نے کہا کہ ابھی ہم یہ کیس سن سکتے ہیں یا نہیں؟
جسٹس منصورعلی شاہ نے کہا کہ تھوڑا وقت دیں تو دیکھتے ہیں کیا ہوتا ہے۔
جسٹس عائشہ ملک نے کہا کہ آرٹیکل 2 اے کے مطابق پریکٹس اینڈ پروسیجر کمیٹی اس کا فیصلہ کرے گی جس میں ابھی وقت لگے گا، پریکٹس اینڈ پروسیجر کمیٹی اس کا فیصلہ کرے گی کہ کیا کیس آئینی بینچ سنے گا یا ریگولر بینچ۔

جسٹس منصور علی شاہ نے کہا کہ ہم آپ کی گزارش پر کوئی نکتۂ نظر نہیں دے سکتے، کیس کو ملتوی کر دیتے ہیں، ہم صرف گپ شپ لگا رہے ہیں۔
سپریم کورٹ نے کیس کی سماعت غیر معینہ مدت تک ملتوی کر دی۔

A constitution bench was mentioned during the hearing of a tax related case in the Supreme Court. A 3-member bench headed by Justice Mansoor Ali Shah heard the case.
During the hearing, Justice Ayesha Malik said that the constitutional bench will hear the case, we are hearing the case in the regular bench.
Justice Mansoor Ali Shah said that currently there is no constitutional bench, so what is to be done with the unconstitutional bench that is sitting? Are we unconstitutional until the constitutional bench sits? It means that constitutional cases will not be heard until the constitutional bench sits.
He said that even if we hear this case, no one can ask us. Again and again the question comes up whether the case will be heard by the regular bench or the constitutional bench. Even if we decide the case, what will happen? Who is going to stop us? If the revision comes to us, we will say that we have jurisdiction, the regular bench cannot hear constitutional cases, there is no support from the lawyers either.
Justice Aqeel Abbasi said that we can hear this case now or not?
Justice Mansoor Ali Shah said that if we give some time, we will see what happens.
Justice Ayesha Malik said that according to Article 2A, the Practice and Procedure Committee will decide which will take time, the Practice and Procedure Committee will decide whether the case will be heard by a constitutional bench or a regular bench.
Justice Mansoor Ali Shah said that we cannot give any opinion on your request, postpone the case, we are just gossiping.
The Supreme Court adjourned the hearing of the case indefinitely.
