Establishment of Constitutional Court is necessary, it is compulsory: Bilawal Bhutto

چیئرمین پیپلز پارٹی بلاول بھٹو نے سندھ ہائیکورٹ بار میں وکلا سے خطاب کرتے ہوئے کہاکہ سندھ ہائیکورٹ بار کا شکر گزار ہوں، سندھ ہائیکورٹ کے وکلا سے خطاب کرنے پر خوشی ہے، اس بار سے ہماری بہت سی یادیں جڑی ہیں، ہمارا تعلق آج سے نہیں 3 نسلوں سے ہے، میں اس خاندان اور جماعت سے ہوں جس نے سزمین بے آئین کو آئین دیا۔
انہوں نے کہا کہ ہم یہ کام سب سے زیادہ جانتے ہیں، ہم 3 نسلوں سے آئین سازی کرتے آرہے ہیں، آج اگر پاکستان ایک طاقتور ملک ہے تو 1973 کے آئین کی وجہ سے ہے، جن حقوق کی آج بات کی جاتی ہے وہ سب اسی آئین کی وجہ سے ملتے ہیں۔
بلاول بھٹو نے کہا کہ ہماری تاریخ کچھ ایسی ہے کہ ہم نے آمرانہ دور بھی دیکھا، ہم نے دیکھا کہ کس طریقے سے معزز جج صاحبان آمر کو کام کرنے دیتے ہیں، بی بی شہید نے آئین کی بحالی کیلئے جدوجہد کی، بی بی شہید نےضیاالحق جیسے آمر کا مقابلہ کیا۔
چیئرمین پی پی پی نے کہا کہ آمرانہ دور میں ہمارے آئین کو کاغذ کا ٹکڑا سمجھ کر پھاڑا گیا، جب ہم جج صاحبان کے سامنے پیش ہوتے تھے اور وہ ہمیں آئین کا درس دیتے تھے، وہی ججز آمر کو مکمل آزادی سے ہر کام کرنے کی اجازت دیتے تھے ، ہمیں کہا جاتا تھا کہ آپ لوگ تو کرپٹ ہیں۔
بلاول بھٹو زرداری کاکہنا تھا کہ انصاف دلانے والے ادارے نے قائدعوام کا عدالتی قتل کیا ، ایک آمر کو سلیوٹ مارا گیا اور ایک سیاستدان کو 11 سال جیل میں رکھا گیا، ایک بار پی سی او جج کا حلف لینا ٹھیک لیکن دوسری بار حلف لینا بہت برا، ہم نے عوام کی مرضی کا قانون اور آئین بنانے کی بات کی، ہم نے جمہوریت کی بحالی کیلئے نسلوں کی قربانیاں دیں، بی بی شہید نے ملک کے استحکام کیلئے چارٹر آف ڈیموکریسی پر دستخط کیے۔
چیئرمین پی پی پی نے کہا کہ آئین میں 18 ویں ترمیم کرکے بی بی شہید کے مشن کو پورا کیا، 18ویں ترمیم کے تحت صوبوں کو اختیارات دیئے گئے، ضیاالحق کے دور میں جمہوریت پسند ہر کارکن پر ظلم ہوا، شہید بی بی نے طے کیا تھا کہ آئینی عدالت بنے گی، جوڈیشل ریفارمز ہوں گی۔
سا بق وزیرخارجہ نے کہا کہ معزز جج صاحبا ن نے ریاست کو ماں کی طرح بنانا تھا، انہوں نے پارلیمان کے آئین کو استعمال کرکے ہمارے تین نسلوں کی محنت کو ضائع کرنے کی دھمکی دی، یہ وہی سوچ ہو جو آمر کی سوچ ہے، یونائیٹڈ سٹیٹ کی مثال لے لیں،جب سپریم کورٹ کے جج کی تعیناتی ہوتی ہے تو پوری پارلیمان سامنے بیٹھی ہوتی ہے، بیرون ملک سپریم کورٹ کے جج کےپورے ماضی کے بارے میں پوچھا جاتا ہے۔
ان کاکہنا تھا کہ قانون سازی اور آئین سازی عدالت کے ذریعے نہیں ہوسکتی، اٹھارہویں ترمیم جنہوں نےدی وہ موجود ہیں ان سے پوچھ سکتے ہیں، آپ وکلا اس لیے بنے ہیں کہ عوام کو انصاف دیں، پتہ نہیں کتنے کیسز زیر التوا ہیں جو عدالت کے سامنے پڑے ہیں، ہمیں 45سال بعد تاریخی کامیابی ملی، آپ نے اس کیس کا سنا ہے جہاں 2بھائیوں کو قتل کا مجرم قرار دیا گیا، سالوں بعد پتہ چلا وہ دونوں بھائی بے گناہ ہیں اور رہا ئی دی گئی۔
بلاول بھٹو نے کہا کہ کسی حکومت کی حمایت یا ترمیم کیلئے نہیں آیا، میں چارٹر آف ڈیموکریسی اور عدالتی ریفارمز کیلئے آیا ہوں، وفاقی عدالت میں ہر صوبے کی برابر کی نمائندگی ہوگی، عوام کو انصاف دلانے کیلئے جو ادارہ بنا ہے ان کو کام کرنے دیں، ہم آئینی عدالت بنائیں گے جو دیکھیں گے کہ آئینی ،سیاسی کیسز کیا ہیں؟۔
انہوں نے مزیدکہا کہ آئینی اصلاحات ان کیلئے نئی چیز ہے جن کی تاریخ تحریک عدم اعتماد سے شروع ہوتی ہے، دنیا میں عدم اعتماد واحد جمہوری پارلیمانی طریقہ ہے، یہ اختیار پارلیمان کے پاس ہے کسی جج یا جنرل کے پاس نہیں، تاریخ میں پہلی بار عدم اعتماد کے ذریعے ایک وزیراعظم کو گھر بھیجا، 63اے کا جب فیصلہ لکھا جارہا تھا کیا کسی نے آئین پڑھا؟ کیا کسی نے سوچا کہ ہم کتنا بڑا فیصلہ سنانے جارہے ہیں۔
چیئرمین پیپلز پارٹی کاکہنا تھا کہ عدالت نے یہ اختیار اپنے پاس لے لیا کہ آئین ہم لکھ سکتے ہیں، مرضی یہ تھی کہ پی ڈی ایم کی پنجاب حکومت نہ بنے، فیصلہ یہ تھا کہ آپ ووٹ پارٹی کے خلاف نہیں دے سکتے، دیتے ہوتو گنا نہیں جائے گا، پھر بھی ایسا کرتے ہیں تو گنا نہیں جائے گا، بتائیں کس آئین کے مطابق یہ فیصلے دیئے گئے؟ ۔
ان کامزید کہنا تھا کہ ہمارا نظام ٹوٹا پھوٹا ہے لیکن ہم اس کو ٹھیک کرنے نکلے ہیں، آپ شہبازشریف ، جج یا کسی ادارے کی نیت پر شک کرتے ہیں تو کریں لیکن آپ میری نیت پر شک نہ کریں، ہم آئینی عدالت بنا کر رہیں گے۔
