PTI founder granted bail in Toshakhana 2 case

اسلام آباد ہائی کورٹ نے توشہ خانہ ٹو کیس میں بانئ پی ٹی آئی کی ضمانت منظور کر لی۔
بانئ پی ٹی آئی کی توشہ خانہ کیس ٹو میں ضمانت کی درخواست پر اسلام آباد ہائی کورٹ کے جسٹس میاں گل حسن اورنگزیب نے سماعت کی۔
عدالتِ عالیہ کی جانب سے بانیٔ پی ٹی آئی کو 10، 10 لاکھ روپے کے مچلکوں کے عوض ضمانت دی گئی۔
دورانِ سماعت ایف آئی اے کے پراسیکیوٹر نے کہا کہ عدالت جو بھی فیصلہ کرے لیکن میڈیا میں پہلے سے ہے کہ ضمانت ہو جائے گی۔
جسٹس میاں گل حسن اورنگزیب نے کہا کہ میڈیا سے خود کو مستثنیٰ کر لیں، میڈیا میں کہا جاتا ہے کہ جان کر بیمار ہو گیا، جان کر نہیں آیا، میڈیا اگر سنسنی نہیں پھیلائے گا تو ان کا کاروبار کیسے چلے گا؟
عدالت نے سوال کیا کہ انہوں نے جیولری سیٹ کا تخمینہ کیسے لگایا ہے؟
بانئ پی ٹی آئی کے وکیل بیرسٹر سلمان صفدر نے کہا کہ یہ تو عدالت میں استغاثہ بتائے گا۔
عدالت نے سوال کیا کہ چالان میں رسید بشریٰ بی بی کی ہے یا بانئ پی ٹی آئی کی؟
بیرسٹر سلمان صفدر نے بتایا کہ چالان میں رسید پر بشریٰ بی بی کا نام ہے، صہیب عباسی کو اس کیس میں وعدہ معاف گواہ بنایا گیا ہے، انعام اللّٰہ شاہ کو استغاثہ نے گواہ بنایا ہے وہ وعدہ معاف گواہ نہیں ہے، نیب، ایف آئی اے، پولیس اور الیکشن کمیشن نے بھی توشہ خانہ کیس کیا ہے، پولیس نے بھی توشہ خانہ جعلی رسید کا کیس بنایا ہوا ہے، الزام ہے کہ بانئ پی ٹی آئی نے ذاتی مفاد کے لیے اپنا اثر و رسوخ استعمال کیا، اس چالان میں یہ واضح نہیں کہ مرکزی ملزم کون ہے؟ توشہ خانہ نیب کیس میں بانئ پی ٹی آئی کو 14 سال کی سزا ہوئی ہے۔
عدالت نے سوال کیا کہ اسلام آباد پولیس نے کیا مقدمہ بنایا ہے؟
وکیل سلمان صفدر نے کہا کہ تھانہ کوہسار پولیس نے جعلی رسیدوں کا مقدمہ بنایا ہے، ایک گراؤنڈ یہ بھی ہے کہ اس کیس کو رجسٹر کرنے میں ساڑھے 3 سال کی تاخیر ہوئی ہے، جس کیس میں جرم واضح نہ ہو تو کیس مزید انکوائری اور ضمانت کا ہے، توشہ خانہ پالیسی کے مطابق تحائف لیے گئے ہیں، تحائف کی اس وقت جو مالیت تھی پالیسی کے مطابق ادا کر کے وصول کیے گئے، توشہ خانہ پالیسی 2018ء کی سیکشن ٹو کے تحت تحائف لیے گئے۔
جسٹس میاں گل حسن اورنگزیب نے کہا کہ گزشتہ حکومت توشہ خانے کی تفصیلات نہیں بتاتی تھی، ہم پوچھتے تھے تو توشہ خانہ کی تفصیلات چھپائی جاتی تھیں، ہائی کورٹ میں گزشتہ حکومت کا مؤقف تھا کہ توشہ خانہ تحائف کا کسی کو پتہ نہیں ہونا چاہیے، کیا آپ نے گواہوں کے بیانات پڑھے ہیں؟
ایف آئی اے کے تفتیشی افسر نے کہا کہ 18 ستمبر کو گواہوں کو نوٹس کیا تھا، گواہوں نے آ کر پہلے سے نیب کو دیے گئے بیانات کی تصدیق کی ہے۔

ایف آئی اے کے پراسیکیوٹر عمیر مجید نے کہا کہ بلغاری سیٹ توشہ خانے میں جمع ہی نہیں کرایا گیا، ریاست کے تحفے کی کم قیمت لگوا کر ریاست کو نقصان پہنچایا گیا، بانئ پی ٹی آئی اور ان کی اہلیہ دونوں نے فائدہ اٹھایا۔
