Wants consultation with all parties: Bilawal Bhutto

آئینی ترمیم سے متعلق تحفظات، مشاورت اور تجاویز کیلئے پارلیمانی کمیٹی کا اجلاس ہوا جس میں بلاول بھٹو زرداری، مولانا فضل الرحمان، بیرسٹر گوہر سمیت دیگر رہنماؤں نے شرکت کی۔
اسلام آباد میں میڈیا سے گفتگو کرتے ہوئے بلاول بھٹو زرداری نے کہا کہ پارلیمانی کمیٹی کا تفصیلی اجلاس ہوا، پیپلز پارٹی کا مسودہ ہم نے کمیٹی میں پیش کیا، آئینی عدالت اور ججوں کے تقرر کے طریقہ کار کے حوالے سے وکلاء تنظیموں کا موقف پیش کیا گیا جبکہ حکومت نے بھی اپنی تجاویز بھی پیش کیں۔
انہوں نے بتایا کہ ہم نے یہ ڈرافٹ حکومت کے علاوہ تمام سیاسی جماعتوں کے سامنے پیش کیا، اس کے علاوہ حکومت نے جو وکلاء سے بحث کی اس کے نکات بھی اس کمیٹی میں پیش ہوئے۔
چیئرمین پی پی پی کا مزید کہنا تھا اپوزیشن جماعتوں نے بھی آئینی ترمیم پر تبصرہ کیا، مولانا فضل الرحمن نے پیپلز پارٹی کے ساتھ مل کر متفقہ مسودہ تیار کرنے کا عزم دہرایا، امید ہے اپوزیشن جماعتوں کے ساتھ بامعنی گفتگو ہو گی، حکومت بھی پر عزم ہے۔
اس موقع پر وزیر قانون اعظم نذیر تارڑ نے کہا کہ آج کمیٹی کے اجلاس میں کافی تجاویز سامنے آئی ہیں، سیاسی جماعتوں کے ساتھ اتفاق رائے کرکے آئینی ترمیم ہو کوشش بھی یہی تھی، آج بھی یہی بات کہتے ہیں کل بھی یہی کوشش ہوگی ، ہم صرف مخالفت برائے مخالفت نہیں کرنا چاہتے،اگر حکومت واقعی دو تہائی اکثریت رکھتی ہے اور مشترکہ مسودہ لاناچاہتی ہے تو یہ بہترین کام ہے۔
اعظم نذیر تارڑ نے کہاکہ لیکن حکومت دیگر سارے کام چھوڑ کر کب تک انتظار کرے کہ مشترکہ ڈرافٹ بن جائے، ہم نےاس سے پہلے بھی ترامیم مشاورت سے کرائی ہیں لیکن حکومت کا مؤقف بھی وزن رکھتا ہے۔
انہوں نے کہاکہ کل کمیٹی کا اجلاس 12 بجے پھر ہوگا، ہیجان کی جو کیفیت پیدا کررکھی تھی وہ کم از کم ختم ہوگئی ہے۔
بلاول بھٹوزرداری سے صحافیوں نے سوال کیا کہ آپ نے نواز شریف، مولانا سمیت سب سے تفصیلی ملاقاتیں کیں ، آج پی ٹی آئی سمیت دیگر سے بھی مشاورت ہوگئی مگر اتفاق رائے پر کس حد تک قائل کرسکے ؟ اگر اتفاق رائے نہ ہو پایا تو کیا حکومت جو آپ نے بقول پر اعتماد ہے اسے حق نہیں کہ وہ آئینی ترمیم کیلئے آگے بڑھے؟ ۔ جس کا جواب دیتے ہوئے بلاول بھٹو زرداری نے کہا کہ آپ کا جواب نہ صرف اپنی جگہ پر بہتر بلکہ انتہائی اہم ہے اور اپنی جگہ پر موجود ہے ، حکومت کا شکر گزار ہوں کہ ہمارے اصرار پر کہ سب سیاسی جماعتوں کے درمیان اتفاق رائے ہونا چاہیے ۔
انہوں نے کہا کہ ہمیں حکومت نے مکمل وقت دیا اور ستمبر سے ہم اس پر کوشاں ہیں، اگر مکمل اتفاق رائے نہ ہوا تو حکومت کب تک انتظار کرے گی؟، ابھی تک صرف پیپلز پارٹی کا مکمل مسودہ سامنے آیا ہے جے یو آئی کا مسودہ ابھی تک ہمیں نہیں ملا ۔
ان کاکہنا تھا کہ ہمارا مسودہ دو ہفتے قبل کامران مرتضیٰ کو مل گیا تھا، ہماری تجویز پر ہی اتفاق ہوا کہ قانون سازی ایس سی او سمٹ کے بعد کی جائے لیکن میں کب تک صرف اپنا مسودہ لے کر پھرتا رہوں گا ، اتفاق رائے نہ ہوا تو پھر حکومت کو اختیار ہے وہ 25 سے بہت پہلے بھی آئینی ترمیم لاسکتی ہے، پی ٹی آئی سمیت تمام جماعتوں کو انگیجمنٹ کرنے کی کوشش کی ہم چاہتے ہیں کہ سیاستدان اور پارلیمان اپنی سپیس واپس لے۔
آئینی ترمیم سے متعلق پاکستان پیپلزپارٹی نےمسودہ شیئرکردیا
پاکستان پیپلز پارٹی کی جانب سے جاری مسودے میں آرٹیکل 175 اے میں آئینی عدالت کا قیام شامل ہے جبکہ آرٹیکل 175 اے، بی ، ڈی، ای ، ایف میں ترامیم کی تجویز بھی شامل کی گئی ہے ۔
مسودے کے مطابق آئینی عدالت وفاق میں جبکہ صوبوں کی سطح پر بھی ایک ایک آئینی عدالت ہونی چاہئیے، ترمیم کے مطابق ہائی کورٹس، لوئر کورٹس کی اپیل سن سکے گی، مسودہ میں وفاقی ائینی عدالت کے ججز کی تعیناتی کا طریقہ کار بھی طے کیا گیا ہے ۔
پیپلز پارٹی کی جانب سے جاری مسودے میں کہا گیا ہے کہ ججز کی تعیناتی کیلئے آئینی کمیشن آف پاکستان کا قیام عمل میں لایا جائے، صوبائی سطح پر ججز کی تعیناتی کا عمل بھی آئینی کمیشن آف پاکستان دیکھے گا۔
آئینی ترامیمی مسودہ میں 20سے زائد ترامیم کی تجویز دی گئی ہے ، آرٹیکل 175اے اے میں اضافی ترمیم شامل کرنے کی تجویز ہے جبکہ آئینی ترمیم کے تحت وفاقی آئینی عدالت کاقیام عمل میں لایاجائے ۔

Chairman PPP further said that the opposition parties also commented on the constitutional amendment, Maulana Fazlur Rahman reiterated his commitment to prepare a consensus draft together with the People’s Party, it is hoped that there will be a meaningful discussion with the opposition parties, the government too. On this occasion, Prime Minister of Law Nazir Tarar said that many proposals have come out in the meeting of the committee today, the attempt was made to amend the constitution by consensus with the political parties. Don’t want to just oppose for the sake of opposition, if the government really has a two-thirds majority and wants to bring a joint draft, that’s the best thing to do.
Azam Nazir Tarar said, “But how long should the government leave all other work and wait for a joint draft to be made? We have already made amendments through consultation, but the government’s position also has weight.”
He said that tomorrow the meeting of the committee will be held again at 12 o’clock.
Journalists asked Bilawal Bhutto-Zardari that he had the most detailed meetings with Nawaz Sharif, Maulana, today there was a consultation with others including PTI, but to what extent could he convince on consensus? If a consensus could not be reached, does the government, which you have confidence in, not have the right to move forward for constitutional amendment? . Responding to which Bilawal Bhutto Zardari said that your answer is not only better in its place but also very important and is there in its place, I am grateful to the government for our insistence that there should be a consensus among all political parties. .
He said that we have been given full time by the government and we have been working on it since September. If there is no consensus, how long will the government wait? So far, only the full draft of the PPP has come out, the draft of the JUI. We haven’t found it yet.
He said that our draft was received by Kamran Murtaza two weeks ago, it was agreed on our proposal that the legislation should be made after the SCO Summit, but how long will I continue to carry only my draft, there was no consensus. So the government has the power, it can bring constitutional amendment long before 25, try to engage all parties including PTI, we want politicians and parliament to take back their space.
Pakistan People’s Party shared the draft related to constitutional amendment
In the draft issued by the Pakistan People’s Party, the establishment of the Constitutional Court is included in Article 175A, while the proposal of amendments has also been included in Article 175A, B, D, E, F.
According to the draft, there should be a constitutional court in the federation, while there should be a constitutional court at the provincial level as well. According to the amendment, the high courts and lower courts will be able to hear appeals. is
In the draft issued by the People’s Party, it has been said that the Constitutional Commission of Pakistan should be established for the appointment of judges.
More than 20 amendments have been proposed in the constitutional amendment draft, it is proposed to add additional amendments to Article 175AA while the Federal Constitutional Court should be implemented under the constitutional amendment.
