Child justice is very important, children are our present and future: Justice Mansoor Ali Shah

اسلام آباد میں بچوں کے انصاف سے متعلق تقریب سے خطاب کرتے ہوئے جسٹس منصور علی شاہ کا کہنا تھا کہ چائلڈ جسٹس بہت اہمیت کا حامل ہے، بچے ہمارا حال اور مستقبل ہیں، بچوں کو بہتر مستقبل کیلئے آگے جانا ہوگا، ججز کو بتانا چاہتا ہوں بچوں کیلئے انصاف کتنا اہم ہے۔
انہوں نے کہا کہ ہم بچوں سے کبھی مشورہ نہیں کرتے، ہم خود اپنے طور پر کوئی بھی فیصلہ کر لیتے ہیں، برائے مہربانی اپنے بچوں کو سنا کریں، اپنے بچوں سے ملیں ان کی باتیں سنیں اور ان کو مانیں، بچے کل کے لوگ نہیں آج کے افراد ہیں، بچوں کے ساتھ عام آدمی کی طرح برتاؤ نہیں کیا جاسکتا۔
ان کا کہنا تھا کہ چائلڈ کورٹ بنانا مشکل نہیں ہے،ہمیں اس پر کام کرنا چاہیے، ججز کا ٹیسٹ یہ ہے کہ بچوں کے ساتھ کیسا برتاؤ کرتے ہیں، بچوں کی پروٹیکشن سے متعلق عالمی قوانین بنائے گئے، ہمارے ملک میں بچوں کی صحت کے حوالے سے ایشوز ہیں، بچوں کی تعلیم سے متعلق بھی ہمیں کام کرنا ہے۔
جسٹس منصور علی شاہ نے کہا کہ میں اگرچہ آئینی بنچ میں نہیں ہوں مگر ہم آپ کو سنیں گے، عدلیہ کو بچوں کے حقوق کا احساس ہے، بچے اللہ کا تحفہ ہیں، ماتحت عدلیہ کے ججز کو بتانا چاہتا ہوں بچوں کیلئے انصاف کس قدر اہم ہے، ہمیں خصوصی بچوں کی کئیر کرنی ہے، چائلڈ میرج بھی پاکستان کا ایک بہت بڑا مسئلہ ہے۔
ان کا کہنا تھا کہ چائلڈ لیبر اور چائلڈ ٹریفکنگ بھی پاکستان میں بہت بڑا مسئلہ ہے، مفاد عامہ کے مقدمات سے کافی بہتری آئی ہے، عدلیہ کو بچوں کو بھی فیصلہ سازی کے عمل میں شامل کرنا چاہیے، عدلیہ کو بچوں کے حقوق کو تحفظ کرنا چاہیے، طوطا چوری ہو تو بچہ جیل میں بیٹھا ہے،بچوں کو عدالتی نظام سے مت گزاریں کہیں بچے کو بھی کیس سے گزرنے سے 15 سے 20 سال نہ لگ جائیں۔
انہوں نے کہا کہ ہماری عدالتوں میں بچہ پیش ہوتا ہے تو اس کو بات کا موقع نہیں دیا جاتا، ہم کیسز میں بچوں کے والدین کو سن لیتے ہیں، ماتحت عدلیہ کے ججز کو کہنا چاہتا ہوں آئندہ سے بچہ عدالت میں پیش ہو تو بچے کی بات کو سنیں، تعلیم،صحت اور انصاف بچوں کا حق ہے۔
جسٹس منصور علی شاہ کا مزید کہنا تھا کہ ملک میں چائلڈ کورٹس بنانے کی ضرورت ہے، چائلڈ کورٹس میں بچوں سے متعلقہ کیسز کے جلد فیصلہ ہوں، دیکھنا ہے ہمارا نظام انصاف بچوں کیلئے کیا کر رہا ہے، بچوں کو بھی آزادی رائے کا حق ہے، بچے ہمارے لیے ہم سے زیادہ ہم اہم ہونے چاہئیں۔

Justice Mansoor Ali Shah while addressing a function related to children’s justice in Islamabad said that child justice is very important, children are our present and future, children have to go ahead for a better future, I want to tell the judges. How important is justice for children?
He said that we never consult children, we take any decision on our own, please listen to your children, meet your children, listen to them and believe them, children are not tomorrow’s people. In today’s society, children cannot be treated like normal people.
He said that it is not difficult to create a child court, we should work on it, the test of judges is how they treat children, international laws have been made regarding the protection of children, the health of children in our country. There are issues related to children’s education that we have to work on.
Justice Mansoor Ali Shah said that although I am not in the constitutional bench, but we will listen to you, the judiciary is aware of the rights of children, children are the gift of Allah, I want to tell the judges of the subordinate judiciary how important justice is for children. Yes, we have to take care of special children, child marriage is also a big problem in Pakistan.
He said that child labor and child trafficking is also a big problem in Pakistan, public interest cases have improved a lot, judiciary should also include children in the decision making process, judiciary should protect the rights of children. If the parrot is stolen, the child is sitting in jail, don’t make the children go through the court system, lest it take 15 to 20 years for the child to go through the case.
He said that when a child appears in our courts, he is not given a chance to speak. We listen to the parents of the children in cases. Listen, education, health and justice is the right of children.
Justice Mansoor Ali Shah further said that there is a need to establish child courts in the country, cases related to children should be decided quickly in child courts, we have to see what our justice system is doing for children, children also have the right to freedom of opinion. Children should be more important to us than we are.
