Speaker Balochistan Assembly Abdul Khaliq Achakzai reinstated

سپریم کورٹ نے الیکشن کمیشن کا سپیکر کی معطلی کا فیصلہ کالعدم قرار دیتے ہوئے سپیکر بلوچستان اسمبلی عبدالخالق اچکزئی کو بحال کر دیا۔
سپریم کورٹ میں جسٹس امین الدین خان کی سربراہی میں تین رکنی بنچ نے سماعت کی، دوران سماعت جسٹس امین الدین خان نے استفسار کیا کہ کس ضابطے کے تحت الیکشن کمیشن نے 12 پولنگ اسٹیشنز پر دوبارہ الیکشن کا حکم دیا؟ جسٹس محمد علی مظہر نے ریمارکس دیئے کہ الیکشن کمیشن نے 12 پولنگ سٹیشنز کو دیکھا مگر دیگر کو نظر انداز کر دیا۔
جسٹس امین الدین خان نے ریمارکس دیئے کہ الیکشن کمیشن نے نہ تو انکوائری کی نہ ہی کوئی اصول دیکھا، ڈی جی لا نے عدالت کو بتایا کہ جن 12 پولنگ سٹیشنز پر زیادہ ٹرن آؤٹ کی درخواست کی گئی صرف انہی کو دیکھا گیا۔
جس پر جسٹس محمد علی مظہر نے کہا کہ الیکشن کمیشن کو تو پورے حلقے کی دوبارہ انکوائری کروانا چاہیے تھی، اگر الیکشن کمیشن اپنا کام کر لیتا تو لوگوں کو عدالت نہ آنا پڑتا۔
عدالت عظمیٰ نے پی بی 51 چمن کے 12 پولنگ سٹیشنز پر دوبارہ پولنگ کا الیکشن کمیشن کا حکم بھی کالعدم قراردے دیا ۔
سپریم کورٹ نے تمام امیدواروں کی رضامندی سے معاملہ دوبارہ الیکشن کمیشن کو بھجواتے ہوئے حکم دیا کہ الیکشن کمیشن تمام امیدواروں کو سن کر 10 روز میں فیصلہ کرے

The Supreme Court annulled the Election Commission’s decision to suspend the Speaker and reinstated Speaker Balochistan Assembly Abdul Khaliq Achakzai.
In the Supreme Court, a three-member bench headed by Justice Aminuddin Khan held a hearing. Justice Muhammad Ali Mazhar remarked that the Election Commission looked at 12 polling stations but ignored others.
Justice Aminuddin Khan remarked that the Election Commission had neither conducted an inquiry nor observed any rules, DG Law told the court that only 12 polling stations requested for high turnout were observed.
On which Justice Muhammad Ali Mazhar said that the Election Commission should have re-enquired the entire constituency, if the Election Commission had done its work, people would not have had to come to court.
The Supreme Court also annulled the Election Commission’s order of re-polling at 12 polling stations of PB 51 Chaman.
With the consent of all the candidates, the Supreme Court sent the matter back to the Election Commission and ordered that the Election Commission hear all the candidates and take a decision within 10 days.
