History never forgives: Justice Mansoor Ali Shah

جسٹس منصور علی شاہ نے چیف جسٹس قاضی فائز عیسیٰ کو خط لکھ دیا، خط پریکٹس اینڈ پروسیجر کمیٹی کے بنائے گئے ٹیکس کیس بنچ کے تناظر میں لکھا گیا، خط میں سر تھامس مورے کا قول بھی نقل کیا گیا ہے۔
خط میں جسٹس منصور علی شاہ نے خصوصی بنچ میں بیٹھنے سے انکار کرتے ہوئے کہا کہ لوگ ہمارے اعمال دیکھ رہے ہیں اور تاریخ کبھی معاف نہیں کرتی، پہلے بھی لکھا تھا ترمیمی آرڈیننس پر فل کورٹ بیٹھنے تک خصوصی بنچز کا حصہ نہیں بنوں گا۔
جسٹس منصور علی شاہ نے نیا خط 23 اکتوبر کو لکھا، خط چیف جسٹس کو بطور سربراہ پریکٹس اینڈ پروسیجر کمیٹی لکھا گیا۔
یاد رہے کہ ٹیکس سے متعلق نظرثانی کیس کی آخری سماعت 4 اکتوبر کو ہوئی تھی جب چیف جسٹس آف پاکستان قاضی فائز عیسیٰ کی سربراہی میں تین رکنی بنچ نے سماعت کی تھی، بنچ میں جسٹس منصور علی شاہ اور جسٹس نعیم اختر افغان کو شامل کرنے کا حکمنامہ دیا گیا تھا۔
جسٹس منصور علی شاہ نے ٹیکس سے متعلق مرکزی کیس میں اختلافی نوٹ لکھا تھا، نظرثانی کیس میں جسٹس منصور علی شاہ کو شامل کرنے کا فیصلہ کیا گیا تھا۔
واضح رہے کہ اس سے قبل بھی جسٹس منصور علی شاہ ترمیمی آرڈیننس پر تحفظات کا اظہار کر چکے ہیں اور وہ پریکٹس اینڈ پروسیجر کمیٹی کے اجلاس میں شرکت کئے بغیر چلے گئے تھے۔
جسٹس منصورعلی شاہ نے ججز کمیٹی کو خط لکھ کر کمیٹی میں شمولیت سے انکار کی وجہ بیان کرتے ہوئے کہا تھا کہ جلد بازی میں پریکٹس اینڈ پروسیجر آرڈیننس لایا گیا، جس کے نفاذ کے چند گھنٹوں کے اندر ہی یہ آرڈیننس نوٹیفائی کیا گیا،کمیٹی کو دوبارہ تشکیل دیا گیا اور اس بارے میں کوئی وجہ نہیں بتائی گئی، نہیں بتایا گیا کہ کیوں دوسرے سینئر ترین جج جسٹس منیب اختر کو کمیٹی کی تشکیل سے ہٹا دیا گیا۔

Justice Mansoor Ali Shah wrote a letter to Chief Justice Qazi Faiz Isa, the letter was written in the context of the Tax Case Bench constituted by the Practice and Procedure Committee, the words of Sir Thomas More are also quoted in the letter.
In the letter, Justice Mansoor Ali Shah refused to sit in the special bench and said that people are watching our actions and history never forgives. I had written earlier that I will not be a part of the special benches until the full court sits on the amendment ordinance.
Justice Mansoor Ali Shah wrote the new letter on October 23. The letter was addressed to the Chief Justice as the head of the Practice and Procedure Committee.
It may be recalled that the last hearing of the tax revision case was held on October 4 when a three-member bench headed by Chief Justice of Pakistan Qazi Faiz Isa heard the addition of Justice Mansoor Ali Shah and Justice Naeem Akhtar Afghan to the bench. The decree was given.
Justice Mansoor Ali Shah had written a dissenting note in the main tax case, it was decided to include Justice Mansoor Ali Shah in the revision case.
It should be noted that earlier also Justice Mansoor Ali Shah had expressed reservations about the amendment ordinance and he left without attending the Practice and Procedure Committee meeting.
Justice Mansoor Ali Shah wrote a letter to the Judges Committee explaining the reason for refusing to join the committee and said that the Practice and Procedure Ordinance was brought in haste, within a few hours of its implementation, this ordinance was notified to the committee. It was reconstituted and no reason was given as to why the second most senior judge, Justice Muneeb Akhtar, was removed from the committee.
