It is impossible not to implement the decisions of the Supreme Court: Justice Mansoor Ali Shah

جسٹس منصور علی شاہ نے عدالتی فیصلوں پر عملدرآمد میں درپیش چیلنجز پر قابو پانے کے عنوان سے تقریب سے خطاب کرتے ہوئے کہا کہ مجھے قائم مقام چیف جسٹس پاکستان کہا گیا جو درست نہیں، میں سینئر ترین جج ہوں قائم مقام چیف جسٹس نہیں۔
جسٹس منصور علی شاہ نے کہا کہ جسٹس قاضی فائز عیسیٰ میرے دوست ہیں اور وہ چیف جسٹس پاکستان ہیں، میں سینئر ترین جج ہی ٹھیک ہوں، چیف جسٹس قاضی فائز عیسیٰ تندرست اور توانا ہیں، اللہ پاک ان کو صحت دے، سپریم کورٹ کے فیصلے پر عملدرآمد نہ کرنا غیر آئینی ہوگا۔
انہوں نے مزید کہا کہ کسی کے پاس یہ آپشن نہیں کہ کہے سپریم کورٹ کے فیصلے پر عمل نہیں ہوگا، سپریم کورٹ کے فیصلے پر عملدرآمد نہ ہونا آئین کی خلاف ورزی ہو گی۔ جسٹس منصور علی شاہ کا کہنا تھاکہ جو رائٹ مسلمانوں کے ہیں اقلیتوں کیلئے بھی وہی تمام حقوق ہیں، اقلیتوں کو پریشان ہونے کی ضرورت نہیں، لیکن پاکستان کے بارے میں جو رپورٹ انٹرنیشنل آرہی ہیں وہ ٹھیک نہیں، اس پر کام کرنے کی ضرورت ہے۔
انہوں نے کہا کہ جوڈیشری میں اقلیت سے تعلق رکھنے والے بڑے بڑے نام رہے ہیں، جسٹس منصور علی شاہ کی جانب سے قرآنی آیات کا حوالہ بھی دیا گیا، ہمارے حضور پاکؐ نے کہا مذہبی آزادی سب کو ہے، حضور پاکؐ نے عیسائیوں کے چرچ کی زمین پر قبضہ کرنے سے روکا اور عیسائیوں کو حقوق دیئے۔
جسٹس منصور علی شاہ نے مزید کہا کہ اسلام ہمیں اقلیتوں کے حقوق کی تعلیمات دیتا ہے، اسلام کے بعد آئین پاکستان کی بات کریں تو آئین پاکستان بھی اقلیتوں کو تحفظات فراہم کرتا ہے، آئین پاکستان کے آرٹیکل 21,22,23،25 دیکھیں جو کہ اقلیتوں سے متعلق ہیں۔
انہوں نے کہا کہ سپریم کورٹ نے ایک مقدمہ میں اقلیتوں کیلئے پانچ فیصد کوٹے کا تحفظ یقینی بنایا تھا، سپریم کورٹ قرار دے چکی پاکستان میں رہنے والے تمام شہریوں کے حقوق برابر ہیں، بین المذاہب ہم آہنگی پر مباحثے کی ضرورت ہے، تمام مذاہب دوسرے مذاہب کو جگہ دیتے ہیں تو ان کے ماننے والے کیوں نہیں دیتے؟
جسٹس منصور علی شاہ کا مزید کہنا تھا کہ ہر مذہب ایک دوسرے کو جگہ دے رہا ہے لیکن ہم کیوں اتنے تنگ نظر ہیں، ہمارے بانی قائداعظم محمد علی جناحؒ نے اقلیتوں کے حقوق پر زور دیا، بابا گرونانک سمیت ہر مذہب کے رہنماؤں نے احترام و بردباری کی بات کی، سمجھ نہیں آتی کہ مذہبی انتشار اور غصہ کیوں کیا جاتا ہے؟

Justice Mansoor Ali Shah while addressing the event titled “Overcoming the challenges faced in the implementation of judicial decisions” said that I was called the Acting Chief Justice of Pakistan which is not correct, I am the senior most judge and not the Acting Chief Justice.
Justice Mansoor Ali Shah said that Justice Qazi Faiz Isa is my friend and he is the Chief Justice of Pakistan. I am the most senior judge. Chief Justice Qazi Faiz Isa is healthy and strong. Failure to comply would be unconstitutional.
He further said that no one has the option to say that the decision of the Supreme Court will not be implemented, non-implementation of the decision of the Supreme Court will be a violation of the Constitution. Justice Mansoor Ali Shah said that the right Muslims have all the same rights for the minorities, the minorities do not need to worry, but the international reports about Pakistan are not right, it needs to be worked on.
He said that there have been big names belonging to the minority in the Judiciary, Justice Mansoor Ali Shah also referred to Quranic verses, our Holy Prophet said that religious freedom belongs to everyone, Holy Prophet (PBUH) protected the Church of Christians. Stopped land grabbing and gave rights to Christians.
Justice Mansoor Ali Shah further said that Islam teaches us the rights of minorities, after Islam, if we talk about the Constitution of Pakistan, the Constitution of Pakistan also provides protection to the minorities, see Article 21, 22, 23, 25 of the Constitution of Pakistan which that are related to minorities.
He said that the Supreme Court had ensured the protection of five percent quota for minorities in a case. If you give space to religions, why not their followers?
Justice Mansoor Ali Shah further said that every religion is giving space to each other but why are we so narrow-minded, our founder Quaid-e-Azam Muhammad Ali Jinnah emphasized the rights of minorities, leaders of every religion including Baba Guru Nanak respected and Speaking of tolerance, don’t understand why there is religious chaos and anger?
