Fundamental rights of all people are very important: Chief Justice

سپریم کورٹ آف پاکستان میں نئے عدالتی سال کے آغاز پر فل کورٹ ریفرنس منعقد ہوا جس کی سربراہی چیف جسٹس پاکستان قاضی فائز عیسیٰ نے کی۔
جسٹس منصور علی شاہ بیرونِ ملک ہونے کی وجہ سے ریفرنس میں شریک نہیں ہوئے جبکہ شریعت اپیلٹ بنچ کے ارکان جسٹس قبلہ ایاز اور جسٹس خالد مسعود نے بھی فل کورٹ ریفرنس میں شرکت کی۔
فل کورٹ ریفرنس سے خطاب کرتے ہوئے جسٹس پاکستان قاضی فائز عیسیٰ نے کہا کہ اس طرح کے موقعوں پر اس بات پر نظر ڈالی جاتی ہے کہ ادارے کی کارگردگی کیسی رہی، اٹارنی جنرل اور بار کے نمائندوں نے بتایا کہ کس طرح کارگردگی بہتر کی جا سکتی ہے، مجھے 9 دن بعد بطور چیف جسٹس ایک سال مکمل ہو جائے گا، میں جب چیف جسٹس بنا تو 4سال میں پہلی مرتبہ فل کورٹ بلایا۔
چیف جسٹس قاضی فائز عیسیٰ نے کہا کہ میں کیس میں سے بدنیتی کا عنصر نکال دیتا ہوں، کچھ لوگ پراسکیوشن کی بات زیادہ مانتے ہیں، پہلے بینچ دیکھ کر ہی بتا دیا جاتا تھا کہ کیس کا فیصلہ کیا ہو گا، اب تو مجھے خود بھی معلوم نہیں ہوتا کہ میرے دائیں بائیں جانب کون سے ججز کیس سنیں گے
انہوں نے کہا کہ ہم سمجھتے ہیں لوگوں کے نہیں کچھ اہم لوگوں کے بنیادی حقوق اہم ہیں، سب لوگوں کے بنیادی حقوق اہم ہوتے ہیں، مفروضوں پر نہ چلیں ،ہوسکتا ہے بتانے والے غلط فہمی میں ہوں۔
چیف جسٹس نے کہا کہ سب کو پتہ ہے نگران حکومت تھی اور الیکشن نہیں ہورہے تھے، الیکشن پٹیشن سپریم کورٹ کے سامنے آئی،تین دن سنوائی ہوئی،بارہ دن میں فیصلہ ہوگیا، ہم نے اپنے اختیارات سے تجاوز نہیں کیا، صدر صاحب فرمارہے تھے الیکشن کی تاریخ دینے کا اختیار سپریم کورٹ کا ہے، الیکشن کمیشن کہہ رہا تھا کہ الیکشن کی تاریخ دینے کا اختیار ہمارا ہے۔

A full court reference was held at the beginning of the new judicial year in the Supreme Court of Pakistan, headed by Chief Justice of Pakistan Qazi Faiz Isa.
Justice Mansoor Ali Shah did not participate in the reference due to being abroad, while Shariat Appellate Bench members Justice Qibla Ayaz and Justice Khalid Masood also participated in the full court reference.
Addressing the full court reference, Justice Pakistan Qazi Faiz Isa said that on such occasions it is looked at how the performance of the institution has been, Attorney General and Bar representatives told how the performance can be improved. Yes, I will complete one year as Chief Justice after 9 days. When I became Chief Justice, I called full court for the first time in 4 years.
Chief Justice Qazi Faiz Isa said that I remove the element of malice from the case. It is not known which judges on my right and left side will hear the case
He said that we believe that the basic rights of some important people are important and not of the people, the basic rights of all people are important, don’t go on assumptions, maybe the tellers are in a misunderstanding.
The Chief Justice said that everyone knows that there was a caretaker government and elections were not being held. The Supreme Court has the authority to give the date of the election, the Election Commission was saying that the authority to give the date of the election is ours.
