سپریم کورٹ کے سینئر ترین جج جسٹس منصور علی شاہ نے سپریم کورٹ کے فل کورٹ کے پریکٹس اینڈ پروسیجر ایکٹ کے خلاف آنے والے آرڈیننس پر شدید سوالات اٹھاتے ہوئے ججز کمیٹی کوخط لکھ دیا۔جسٹس منصور علی شاہ نے اپنے خط میں لکھا کہ فل کورٹ نے فیصلے کے ذریعے پارلیمنٹ کی مداخلت کے دروازے کو بند کیا ، فل کورٹ کے فیصلے میں واضح کہا گیا کہ کسی ترمیم کے ذریعے اگر مستقل بھی آزاد عدلیہ پر اثر انداز ہونے کی کوشش کی گئی ہے تو یہ آئین کے تحفظ کے لیے موجود یہ عدالت اس سے نمٹے گی۔
خط کے متن میں کہا گیا کہ پریکٹس اینڈ پروسیجر ایکٹ کی تشکیل کا فیصلہ فل کورٹ کا تھا اس میں رد و بدل یا تو فل کورٹ بنچ یا فل کورٹ اجلاس کے ذریعے ممکن ہے ،جب تک کمیٹی کو اصل حال میں بحال نہیں کیا جاتا، شرکت نہیں کروں گا ۔
جسٹس منصور علی شاہ نے خط میں تحفظات کا اظہار کرتے ہوئے کہا ہے کہ سپریم کے فیصلے کی روشنی میں موجودہ آرڈیننس پر شدید سوالات ہیں، موجودہ ترمیمی آرڈیننس کی جوڈیشل تشریح بھی ضروری ہے، ایسی کوئی جلدی نہیں کہ موجودہ ترمیمی آرڈیننس لایا جا رہا ہے۔
خط میں کہا گیا ہے کہ پارلیمنٹ سے ایکٹ میں ترمیم کرانے کی بجائے اس آئینی بحران کے درمیان آرڈینس لایا گیا، ترمیمی آرڈیننس پر سنگین شکوک و شہبات کے باوجود یہ واضح کرنا ضروری ہے کہ ترمیمی کے آرڈینس کے باوجود موجودہ ججز کمیٹی کو کام جاری رکھنے سے نہیں روکتا، لہٰذا اس ترمیم کے باوجود پہلے والی ججز کمیٹی کام جاری رکھ سکتی تھی۔
آرڈیننس جاری کے ہونے چند گھنٹوں میں نئی کمیٹی تشکیل دے دی گئی، کمیٹی تشکیل دیتے ہوئے یہ بھی نہیں بتایا گیا کہ سیکنڈ موسٹ سینئرجج جسٹس منیب اختر کو کیوں نکالا گیا؟
جسٹس منصور علی شاہ نے خط میں کہا کہ جسٹس منیب اختر 11 مارچ سے ججز کمیٹی کی تمام میٹنگ میں شریک رہے اور آج میٹنگ میں شرکت کے لیے تیار تھے، یہ نہیں بتایا کہ سیکنڈ موسٹ سینئر جج کی موجودگی میں چوتھے نمبر پر موجود جج کو کمیٹی کا حصہ کیوں بنایا گیا؟۔
خط میں یہ بھی لکھا گیا کہ ایسے غیر جمہوری من پسند فرد کی سلیکشن اور ون مین پاور شو کو ختم کرنے کےلیے ہی پریکٹس اینڈ پروسیجر ایکٹ لایا گیا تھا، جسے سپریم کورٹ نے بھی منظور کیا تھا، یہاں یہ یاد دہانی کرانی ضروری ہے کہ چیف جسٹس نے بطور سینئر ترین جج ہمیشہ شفافیت کی بات کی۔
جسٹس منصور علی شاہ نے خط میں یہ بھی نقطہ اٹھایا کہ بطور سینئر ترین جج چیف جسٹس نے اصولوں کی بات کرتے ہوئے کئی مہینہ کورٹ ورک کرنے کے بجائے چیمبر ورک کیا تھا، چیف جسٹس نے پریکٹس اینڈ پروسیجر ایکٹ پر بہت زور دیا۔
خط میں یہ بھی کہا گیا کہ اس بات کا اندازہ اس سے بھی لگایا جاسکتا ہے کہ بطور چیف جسٹس انہوں نے پہلا کیس ہی پریکٹس اینڈ پروسیجر ایکٹ کا مقرر کیا تھا، شفافیت ،عدلیہ کی آزادی اس بات کا تقاضا کرتی ہے کہ چیف جسٹس جلد بازی میں نئی کمیٹی بنانے کی بجائے موجودہ آرڈیننس پر فل کورٹ میٹنگ بلائیں۔

A new committee was formed within a few hours of the issuance of the ordinance. While forming the committee, it was not even told why the second most senior judge, Justice Muneeb Akhtar, was removed.
